1. Acceptance of Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and any policies referenced herein. If you do not agree, do not use the Service.

2. Eligibility

3. Accounts & Security

5. User Content

• We may remove or restrict User Content that violates these Terms or applicable laws.

6. Fees, Payments & Taxes

Some features may require payment. If you purchase paid features, you agree to pay the applicable fees and taxes. Fees are non-refundable except as required by law or as expressly stated in a written refund policy.

7. Cancellations, Refunds & Chargebacks

• If subscriptions are offered, you may cancel at any time; cancellation takes effect at the end of the current billing period unless otherwise stated.
• Refund eligibility, if any, will be governed by the refund policy presented at purchase or published on the Service.
• Unauthorized chargebacks or payment disputes may result in suspension or termination of access to the Service.

8. Intellectual Property

The Service, including its software, design, and content (excluding User Content), is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your internal business or personal use (as applicable) in accordance with these Terms.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to defend, indemnify, and hold harmless Dynamic Stone Tools Inc. and our affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Service, (b) your User Content, or (c) your violation of these Terms or applicable law.

14. Termination

We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms, pose a security risk, or if required by law. You may stop using the Service at any time. Sections intended to survive termination will survive (including Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification).

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means. Your continued use of the Service after the effective date of an update constitutes acceptance of the revised Terms.

16. Governing Law & Disputes

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Service will be brought in the state or federal courts located in Virginia, and you consent to personal jurisdiction in those courts.
